Services and Responsibilities of Lumiverse Dynamic

  • The user of the service confirms that the material uploaded to the server will be ready for use and will not require any additional processing by Lumiverse Dynamic to function. Lumiverse Dynamic reserves the right to access the files, websites, and data of the service user.
  • Lumiverse Dynamic notifies the service user via email about how to access their Control Panel and provides instructions on publishing their files online, setting up their email accounts, and the necessity of reviewing the Control Panel user manual.
  • The service user agrees that they possess the necessary knowledge to create and publish their websites on the Internet and acknowledges that Lumiverse Dynamic is not responsible for providing such knowledge or any programming expertise, nor is it obligated to train the user. Lumiverse Dynamic is not required to provide technical support beyond the cases specified herein. However, as an exception and at its discretion, Lumiverse Dynamic may choose to offer assistance or guidance on matters unrelated to website hosting (additional Technical Support).
  • Any request for additional Technical Support may be declined by Lumiverse Dynamic, with or without explanation. The decision to provide additional Technical Support is solely at the discretion of Lumiverse Dynamic and, if offered once, can be withdrawn at any time without prior notice or obligation.
  • Lumiverse Dynamic does not monitor the content of information transmitted through its server network and does not guarantee the reliability of any information displayed on the Internet via or because of its services. Furthermore, it does not guarantee the commercial or personal credibility of anyone presented on the Internet or the fulfillment of any promises/offers made by third parties. Lumiverse Dynamic is not liable for any damages to the service user or their associates, including data loss, due to delays, non-delivery of goods, or service interruptions for any reason, error, or omission.
  • The use of any information provided via the Internet is at the user’s own risk, and Lumiverse Dynamic holds no responsibility for the accuracy or quality of such information.
  • Lumiverse Dynamic is not liable for any damage caused by network or system unavailability and does not guarantee uninterrupted hosting services or error-free operations due to the inherent nature of the Internet and the networks through which information is distributed.
  • Under no circumstances and for no reason shall Lumiverse Dynamic be held liable for any damage arising from the use, availability, or unavailability of its services.
  • Lumiverse Dynamic regularly updates the installed applications on its servers to maintain the highest possible security levels and to provide the latest versions of cPanel, Plesk Control Panel, PHP, MySQL, Perl, Zend, Ioncube, etc. It is the sole responsibility of the service user to update their website code (PHP code, MySQL queries, ASP, etc.) to ensure compatibility with the servers. Lumiverse Dynamic is not liable for any loss, damage, or moral harm caused by these updates or by the inability or unwillingness of the service user to adapt their websites to the upgraded versions of various applications and programming languages installed on Lumiverse Dynamic’s servers.
  • Lumiverse Dynamic bears no liability or obligation for compensation for any loss, damage, or moral harm caused by the inability to provide services or technical support. By accepting this agreement, the service user agrees not to raise any claims of any kind.
  • Lumiverse Dynamic periodically backs up files and databases of clients using hosting services on its servers. File recovery from backups is charged on a case-by-case basis. Lumiverse Dynamic assumes no responsibility if the backup is outdated or unusable. The service user is obligated to maintain backups of their files and databases using the Backup/Restore tool provided through the Plesk Panel or cPanel. For security reasons, the backup should be transferred via FTP to the service user’s computer.
  • Lumiverse Dynamic delivers services/products within 1-2 hours of payment confirmation. In some cases, due to the nature of the service, delivery may be delayed by several additional hours or days.
  • Lumiverse Dynamic will cooperate with law enforcement authorities regarding space, data, emails, and user content. This may lead Lumiverse Dynamic to disclose all provided information, including information stored on its servers, user files, and databases.
  • Lumiverse Dynamic is not responsible for damages that may arise from the execution or non-execution of customer orders or the form of service delivery. It also reserves the right to delay the delivery of products/services in cases of force majeure.
  • Lumiverse Dynamic forms partnerships or alliances with other companies and suppliers. The service user acknowledges and agrees that Lumiverse Dynamic bears no responsibility for the products or services of any third party and shall not be liable to the service user or any third party for claims arising from the provision of such products or services.

User Responsibility and Prohibited Use of Servers

The service user agrees not to use the Lumiverse Dynamic website, the services provided, or the servers for the following purposes:

  • Sending, publishing, emailing, or transmitting in any way any content that is illegal, harmful, threatening, offensive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or discriminatory based on race, ethnicity, or other grounds.
  • Causing harm to minors in any way.
  • Sending, publishing, emailing, or transmitting any content that the user does not have the right to transmit under applicable law or contractual or managerial relationships (such as internal information, proprietary and confidential information obtained or disclosed as part of employment relationships or covered by confidentiality agreements).
  • Sending, publishing, emailing, or transmitting any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of third parties.
  • Sending, publishing, emailing, or transmitting any material containing software viruses or any other code, files, or programs designed to interrupt, damage, destroy, or impair the operation of any software or hardware.
  • Willful or unintentional violation of applicable laws or regulations.
  • Harassment of third parties in any way.
  • Illegal collection or storage of personal data about other users.

Lumiverse Dynamic reserves the right to reject or delete material hosted on its servers if such material violates any laws related to intellectual property, copyright, duplication, pornography, racism, or piracy (e.g., hacking, pirated software, warez sites, serial numbers). This includes content related to drug trafficking, attempts at illegal access to computers, or other unlawful activities. In such cases, Lumiverse Dynamic may, without prior notice, immediately deactivate the account and disable access to the site through the internet, without any liability for damages caused to the service user or third parties. The service user will then be notified to remove the offending material. If the user fails to comply immediately, Lumiverse Dynamic reserves the right to permanently delete the account.

Anti-Spam Policy

Lumiverse Dynamic enforces a strict anti-spam policy and may terminate a user’s account in cases of unsolicited or mass email distribution (spam). An email is classified as spam if sent to recipients who have not explicitly requested to receive it. The service user agrees not to send the following types of emails:
(a) Promotional or informational emails, including but not limited to commercial advertisements, except to recipients who have explicitly requested such emails.
(b) Harassing emails, whether due to their language, frequency, or size.
(c) Chain emails.
(d) Bulk promotional or informational emails.

Lumiverse Dynamic reserves the sole right to determine if a user’s actions constitute “spam,” “mail bombing,” or “bulk email.” Users utilizing Lumiverse Dynamic’s services for spamming purposes will incur a management and system recovery fee, the amount of which is determined exclusively by Lumiverse Dynamic.

Lumiverse Dynamic reserves the right to limit the volume of messages sent or received by users to maintain the quality of email services for other members and protect its computer systems.

As the owner and/or administrator of the equipment and resources used to provide services, Lumiverse Dynamic has the authority to block electronic communications from other entities on the internet.

Server resources are intended exclusively for use within the accounts of Lumiverse Dynamic customers. The allocation of resources to third-party sites in any form is strictly prohibited. This includes, but is not limited to, pulling graphics or text from third-party sites, hosting banner exchange programs, etc.

SSH Access
SSH access is provided upon request and only for specific hosting plans (e.g., VPS, Dedicated Servers). Lumiverse Dynamic reserves the right to deny access or grant limited access for executing specific commands.

Prohibited Activities
The following activities are strictly prohibited:

  • Sending unsolicited or disruptive messages to or from servers connected to Lumiverse Dynamic.
  • Attempting to bypass user authentication or security measures of any host, network, or account.
  • Accessing information not intended for the user of the service.
  • Breaching the security of any network, including but not limited to spawning, port scans, ping floods, packet spoofing, router information forging, denial of service attacks, sniffing, flooding, spoofing, ping bombing, smurf attacks, winnuke, teardrop attacks, and distributing viruses.
  • Running chat rooms, Internet Relay Chat (IRC), IRC bots (e.g., eggdrop), PhpShell, or similar programs.
  • Streaming audio, radio, or video content.
  • Uploading files to the server for public downloading.

Unauthorized Processes
Unauthorized background processes or authorized processes that compromise server security will result in the suspension or termination of the user’s account.

Any activity, regardless of whether it leads to data loss, will be investigated, and appropriate action will be taken.

The user agrees to design their websites in a manner that prevents overloading the Lumiverse Dynamic servers, minimizing the use of code and applications that require significant processing power.

Lumiverse Dynamic reserves the right to immediately and without prior notice disable access to the user’s website if it causes issues that disrupt hosting services for other customers on the same server.

In such cases, the user will be notified as soon as possible, and Lumiverse Dynamic will cooperate with the user to resolve the issue that led to the suspension of services.

The user agrees to comply with the following conditions:

  1. Avoiding Server Overload
    Users must not engage in intentional or unintentional actions that may overload the server, such as using CGI scripts, PHP scripts, FTP, HTTP, or SMTP processes. (This condition does not apply to Dedicated Servers.)
  2. Independent Processes
    Users must not execute any standalone processes on the server. (This condition does not apply to Dedicated Servers.)
  3. Prohibited Daemons and Executables
    Users must not run daemons or executable files that excessively consume bandwidth, such as IRCD, chat daemons, .exe, .com, etc.
  4. Web Spiders or Indexers
    Running any type of web spider or indexer (e.g., Google Cache/AdSpy) is prohibited.
  5. BitTorrent Applications
    Users must not run BitTorrent applications, trackers, or clients, nor host or link to any illegal files shared via such methods.
  6. File Sharing and P2P Networks
    Users must not participate in activities related to file-sharing or peer-to-peer networks.
  7. Gaming Servers
    Hosting gaming servers, such as Counter-Strike, Half-Life, Battlefield 1942, etc., is prohibited. (This condition does not apply to Dedicated Servers.)
  8. Cron and Scheduled Tasks
    Users must not set cron tasks or scheduled tasks to run at intervals shorter than 30 minutes. (This condition does not apply to Dedicated Servers.)
  9. Remote File Calls
    Scripts must not call files that are not local. For shared hosting packages, any remote file or URL calls must be disclosed to Lumiverse Dynamic. Lumiverse Dynamic reserves the right to prohibit such actions without prior notice.
  10. Mass Emailing
    SMTP usage for mass promotional or informational email distribution is prohibited. Such actions should be performed exclusively through the provided mailing list service or third-party applications.

Terms of Service – Usage and Resource Management

  1. Proper Use of Services and Equipment
    Users must use Lumiverse Dynamic’s services and equipment in compliance with this agreement. Any activity that disrupts the functionality of the equipment or network is strictly prohibited. Excessive resource usage is not acceptable. If, in Lumiverse Dynamic’s discretion, a user’s resource usage exceeds allowable limits and causes system overload, the account may be suspended until the cause is identified and resolved. Lumiverse Dynamic reserves the right to neutralize resource-intensive mechanisms that strain the CPU. (This condition does not apply to Dedicated Servers.)
  2. Reselling Restrictions
    Shared Hosting accounts may not be resold to third parties. Users interested in reselling hosting services must use a Reseller Hosting package.
  3. Backup Limitations
    Services provided by Lumiverse Dynamic, such as storage, email, or bandwidth, must not be used for general backup purposes. Users may not upload, download, or store files unrelated to the functionality of their website, except for maintaining one backup of their website. (This condition does not apply to Dedicated Servers.)
  4. Storage Quota Management
    Users must monitor and ensure that the storage space used by their account and its sub-accounts does not exceed the allocated limits. If the usage exceeds the set limits, Lumiverse Dynamic reserves the right to charge for additional resource usage and may delete files to bring usage within acceptable levels. (This condition does not apply to Dedicated Servers.)
  5. Code and Application Security
    Users are responsible for ensuring the security of their installed code and applications, regardless of the installation method. Directory and file permissions must be correctly set, with permissions of 755 or stricter wherever possible. Users are accountable for all activities occurring within their account.
  6. Secure Passwords
    Users must employ secure passwords. If a user’s password is deemed weak, the account may be suspended until a stronger password is set.

Terms of Service – Hosting Services

General Terms

  1. Provider’s Right to Monitor and Remove Content
    Lumiverse Dynamic, as the service provider, reserves the right to monitor the website and, at its discretion, remove any content deemed unacceptable for any reason without prior notice to the website owner. This includes, but is not limited to, the following: pornography, spamming, phishing, illegal business practices, and any material that infringes upon national or international intellectual property rights.
  2. Responsibility of Website Owner
    The website owner, as the user of Lumiverse Dynamic’s service, is solely responsible for any obligations arising from or related to their website. The service user agrees to indemnify and hold the provider, its partners, and employees harmless from any liabilities, losses, damages, expenses, and costs, including attorney fees and expert witness fees, related to any claim or legal action against the provider arising from or related to the website or the breach of warranties by the owner under this agreement. This obligation includes claims arising from the actions or omissions of employees, users, or any other person gaining access to the services on behalf of the service user, due to the failure to implement reasonable security measures.
  3. GPL Software Usage
    Any software used on the website by the service user that is provided under the General Public License (GPL) is governed by the terms of that license.

Provider’s Obligations

  1. Service Provision and Support
    Subject to the service user’s compliance with all the terms and conditions of this Agreement, Lumiverse Dynamic will provide the services and support for the duration of the agreement, in accordance with the service commitments undertaken.

User Obligations

  1. Content Responsibility
    The service user is solely responsible for the content of articles, data, or postings published using the Service, or any other use of the Services by a user. The service user agrees to fully comply with all obligations and restrictions as outlined in the Acceptable Use Policy.
  2. Legal Responsibility
    The service user is exclusively and solely responsible for:
    (1) Their website, its content, and its activity,
    (2) Obtaining legal, written permission for the use and display of any content on their website from the rightful owners of such rights, and
    (3) Ensuring that the content of the website/blog does not violate the laws of the country where it is displayed.
  3. Prohibited Content and Actions
    The service user agrees not to upload or allow the placement of unacceptable material or actions on their website, including but not limited to:
    (1) Defamatory or otherwise illegal material,
    (2) Criminal activities, including but not limited to theft of trade secrets, fraud, child pornography, trafficking in obscene material, violation of export regulations, drug trafficking, gambling, harassment, stalking, spamming, hacking, sending viruses or other harmful files, illegal password or code extraction to bypass copyright security measures,
    (3) Illegal material or activity, including but not limited to unauthorized disclosure of confidential, secret, or proprietary material, infringement of trademarks, violation of intellectual property rights, or patent infringement.
  4. No Backup Storage
    The service user understands and agrees that no part of the services provided by Lumiverse Dynamic, such as space, emails, or data transfer (bandwidth), may be used for backup storage purposes. The service user is not allowed to upload, download, or store files that are not directly related to the operation of their website. The service user is not permitted to upload files intended for audio, radio, and video streaming, or downloading by the public, or gallery sites that excessively use resources.
  5. System Resource Usage
    The user must not abuse the system’s resources at the expense of other users on the same server and must comply with the proper usage of each service provided. In case of abuse, the system will automatically disable the service. The service will be reactivated after communication with the technical support team and after the case has been reviewed individually. Specifically, in the case of exceeding monthly traffic limits, the user can purchase additional traffic packages at a 20% discount. These packages are valid only for the current month and must be paid for in full each month. Additionally, FREE TRANSFER of data from another provider applies only to new purchases of packages lasting more than one month.
  6. Compliance with Terms and Conditions
    The user agrees to comply with all the terms and conditions of this agreement, to make all required payments, and to adhere to any applicable laws governing the use of the services. The user is obligated to cooperate with the provider in investigating service outages, security issues, or any suspected violations of the terms and conditions of this agreement.
  7. Strict Anti-Spam Policy

    The user must comply with the strict anti-spam policy followed by Lumiverse Dynamic. The provider reserves the right to cancel the user’s account if the user sends unsolicited bulk email (spam). An email is considered spam if it is sent to recipients who have not explicitly requested it. The user agrees not to send any of the following types of emails:

    • (a) Advertising or informational emails, including, but not limited to, commercial advertising, except to those who have explicitly requested such emails.
    • (b) Annoying emails, either due to their language, frequency of sending, or message size.
    • (c) Chain mails.
    • (d) Bulk advertising or informational emails.

    Lumiverse Dynamic reserves the right to determine if a user’s action constitutes “spam,” “mail bombing,” or “bulk email.” Users who engage in spamming will be charged a management and system recovery fee. The amount of this fee is determined solely by Lumiverse Dynamic.

    8. Server Resource Allocation

    The available resources of the server are strictly for use within the user’s account. It is prohibited to allocate resources to third-party sites in any form, including but not limited to, the extraction of graphics or text from third-party websites, using materials stored on Lumiverse Dynamic’s servers, executing banner exchange programs, etc.

Intellectual Property Rights

  1. Ownership of Lumiverse Dynamic’s Software and Materials
    All software, programs, code, data, or information developed or provided by Lumiverse Dynamic, as well as any intellectual property rights, trademarks, patents, trade secrets, or any other proprietary rights contained therein, remain the exclusive property of Lumiverse Dynamic.
  2. User’s Ownership of Content
    All content created by the user on their blog/website remains the exclusive property of the user, including all intellectual property rights, trademarks, patents, trade secrets, or other proprietary rights.
  3. No Ownership of Servers or Materials Used in Service
    The user acknowledges and agrees that they have no ownership rights to any of the servers or other materials used to provide the service. Similarly, the user does not acquire any ownership interest in the content or data stored on the servers or transmitted through the service.
  4. Third-Party Software and Hardware
    The user acknowledges and agrees that third parties may be used for the software or hardware provided as part of the service. Therefore, the user agrees to comply with the terms and conditions of any end-user licenses or other agreements related to the use of such software or hardware.
  5. IP Addresses
    The user acknowledges and agrees that any IP addresses assigned in connection with the service are the property of Lumiverse Dynamic and, upon expiration or termination of this agreement, will be released, and the user will cease using any assigned IP address.

Confidentiality

  1. Obligation of Non-Disclosure
    Lumiverse Dynamic agrees not to use or disclose confidential information, unless required by law. It will take appropriate measures to keep confidential information secure from third parties. If the user’s account is closed for any reason, Lumiverse Dynamic will neither use nor disclose confidential information, and such information will either be returned to the user or destroyed.

Suspension of Services

  1. Grounds for Suspension
    The user agrees that Lumiverse Dynamic may suspend the provision of services, in whole or in part, without liability to the user or any third parties claiming to represent the user, in the following cases:

    • (1) The user violates the Acceptable Use Policy.
    • (2) The user does not cooperate with the provider in investigating any alleged breaches of this agreement.
    • (3) If Lumiverse Dynamic reasonably believes that third parties have access to, manage, or use the servers hosting the services without the provider’s consent.
    • (4) If Lumiverse Dynamic deems suspension necessary to protect its infrastructure or environment.
    • (5) If the user’s website causes issues for the hosting services of other customers on the same server.
    • (6) If a subpoena, court order, or legal requirement is issued.

Payment for Services

  1. Payment Terms
    Payments are due as long as this agreement remains in effect. Lumiverse Dynamic reserves the right to modify service prices without prior notice.
  2. Payment Upon Order or Renewal
    Payment for any service must be made at the time of ordering or renewal for paid services. If payment is not completed for any reason, the service will not be activated. If a subscription is not renewed after the expiration date, the website and associated hosting services will be deactivated, but the data will remain available for 15 additional days in Lumiverse Dynamic’s database, during which it can be reactivated upon the user’s request and payment.
  3. Cancellation Policy
    If the user requests cancellation of a service or package before the predetermined expiration, Lumiverse Dynamic will withhold the activation fee and the cost for the current month, with a minimum billing duration equal to the smallest available purchase period for the package. The calculation will exclude any discounts or offers applied to the package.

Duration, Termination, and Cancellation

  1. Commencement of Agreement
    This agreement starts when the package/service order is completed and paid for. It remains valid for the duration of the order and is renewed upon payment for subscription renewal. The agreement expires if the package is not renewed, or if the user requests cancellation of the order, as described in the procedures of Lumiverse Dynamic. The agreement will also cease immediately if a breach of the terms mentioned herein is reported.

Maintenance

  1. Scheduled and Emergency Maintenance
    Lumiverse Dynamic may periodically deactivate the hosting service for scheduled maintenance, upgrades, or repairs to any part of its network. The provider will notify the user via email or through the management interface regarding the period during which the hosting service will be unavailable.

    The user agrees that there may be situations where advance notice for service interruptions is not possible, such as in emergencies. Lumiverse Dynamic also reserves the right to interrupt the service for restoration or repair without prior notice.

  2. Limitation of Liability
    Lumiverse Dynamic is not liable for any loss, damage, or moral harm resulting from the deactivation of services or from upgrades.

Acceptance of Terms of Use

  1. Governing Law and Dispute Resolution
    The user agrees that any disputes arising from the use of this agreement shall be governed by the laws of Greece, and the competent court for their resolution will be the Athens Courts. The terms contained herein supersede any other agreement or negotiation, whether oral, written, or otherwise, including any statements by a representative of Lumiverse Dynamic.
  2. Right to Modify Terms
    Lumiverse Dynamic reserves the right to modify and/or change these terms and conditions at any time.

Disclaimer of Implied Warranties

  1. No Warranty for Service Performance
    Lumiverse Dynamic will make its best efforts to maintain acceptable performance of the Service while this agreement is in effect, but does not provide any express or implied warranty, including warranties of merchantability or fitness for a particular purpose.
  2. No Responsibility for Network or System Downtime
    Lumiverse Dynamic is not responsible for any damage resulting from network or system unavailability. It does not guarantee that hosting services or the integrity of data stored or transmitted via the internet will be uninterrupted or error-free, due to the inherent nature of the Internet and the networks used for data transmission.
  3. No Responsibility for Data Disclosure or Loss
    Lumiverse Dynamic is not responsible for any inadvertent disclosure, bribery, or deletion of data transmitted, received, or classified within its systems. The user is solely responsible for taking appropriate security measures to protect passwords, systems, data, and applications from unauthorized intruders, whether via the Internet or other means.
  4. No Liability for Losses or Damages
    Under any circumstances, Lumiverse Dynamic is not liable to customers or third parties for any loss, damage, or loss of profits, or data arising from the use or inability to use, availability or unavailability of the services it provides.
  5. Exclusion of Liability for Special or Consequential Damages
    In no case shall Lumiverse Dynamic be liable to customers, end users, or any third party for any special, consequential, or other damages resulting from breach of this agreement, negligence, or other causes, even if Lumiverse Dynamic has been warned of the possibility of such damages.
  6. No Responsibility for Service Suspension
    The user agrees that Lumiverse Dynamic shall not assume any obligation or responsibility for service suspension as permitted under this agreement.
  7. No Liability for Loss or Damage from Service or Technical Support Failure
    Lumiverse Dynamic is not liable for any loss, damage, or moral harm arising from the failure to provide services or technical support. The user agrees, by accepting this agreement, not to raise any claims.
  8. Backup Responsibility
    Lumiverse Dynamic periodically creates backups of customer files and databases hosted on its servers. However, Lumiverse Dynamic is not responsible if the backup is outdated or unusable. The user is responsible for maintaining their own backup of files and databases, using the provided backup tool in the Panel (if included in the package) or a third-party program of their choice. For security reasons, backups should be stored locally on the user’s computer.
  9. Liability for Order Execution and Delivery Delays
    Lumiverse Dynamic is not liable for damages resulting from the execution or non-execution of the user’s orders. Additionally, it reserves the right to delay the delivery of products/services in cases of force majeure.

Communication

The user is required to keep their contact information up to date and notify Lumiverse Dynamic of any changes. Communication and notifications from Lumiverse Dynamic to the user regarding account matters (such as server upgrades, subscription expiration/renewal, etc.) will be conducted via email or relevant informational pages on the Lumiverse Dynamic website. The user is obliged to regularly check the email they have designated as their primary contact email and the Lumiverse Dynamic website to stay informed about matters related to their account and subscriptions. The contact email must not be an email hosted on Lumiverse Dynamic’s servers.

Pricing and Service/Agreement Termination

Pricing Policy

The listed prices for products are in euros and do not include VAT. Payment for services and products is made in advance. Lumiverse Dynamic reserves the right to change prices without prior notice to the user. It is understood that the user will always pay the price listed in the relevant price lists for the product or service at the time of ordering. Any payment fees (such as bank deposit fees, etc.) are borne by the user. Prices may include a surcharge for payments made with credit cards, paysafecard, or via PayPal.

Lumiverse Dynamic has the right to offer packages or promotions with more favorable terms or prices than those that applied when the user initially purchased services. These price and terms changes do not affect the existing prices for current services.

Discount coupons are only valid for the initial purchase and do not affect the renewal price of any service or product. Discount coupons cannot be combined with any other discounts that customers may be entitled to.

The price paid by the user for hosting services will never change for the duration of the service’s validity. Lumiverse Dynamic reserves the right to change the resources and prices of hosting services displayed on its website for purchase by future customers.

Termination of Services/Agreement

This agreement may be terminated by either party, without cause. Lumiverse Dynamic is not obliged to refund the agreed amount for the remaining period from the day of termination until the original expiration date if the termination is requested by the user or if the agreement is terminated by Lumiverse Dynamic due to a breach of terms by the user.

If the user indicates that they do not wish to continue the services, Lumiverse Dynamic will terminate the operation of the user’s website and delete it from its servers without further notice.

Lumiverse Dynamic reserves the right to refuse, terminate, or suspend the services it provides to the user at its discretion, with or without prior notice, and will not be responsible for any positive or negative consequences resulting from the termination of a website from its server or the termination of any other service. Restoring files for a hosting account is chargeable.

If the user has any outstanding payments for one or more services, Lumiverse Dynamic has the right to suspend, terminate, or delete all their domains or hosting accounts, whether paid or unpaid, without the obligation to provide backup copies (backups) to the user.

Lumiverse Dynamic reserves the right to cancel an account, including files and content, for any reason, at any time. The user agrees to maintain backup copies of all files and databases hosted with Lumiverse Dynamic and acknowledges that Lumiverse Dynamic will not be responsible for any data loss. The user is solely responsible for creating backups of their data.

If the user no longer desires services from Lumiverse Dynamic, they must communicate this through the available contact methods of Lumiverse Dynamic.

In any case of failure to make timely payment for services, the service will be terminated after its expiration.

Renewal of Services

This renewal agreement is automatically renewed according to the applicable price in the current price list for the type of service provided, only if the customer has requested it through Lumiverse Dynamic’s management system.

In case of subscription payment through a bank (DIAS system) via cashier, e-banking, or phone-banking, the user is responsible for any bank fees.

The user must ensure that Lumiverse Dynamic has received the notification of payment for the subscription and activated/renewed the services for which payment was made. If Lumiverse Dynamic is unable to verify the payment details (e.g., due to a misdialed fax, undelivered email notifications), the company will suspend the services without any liability for any damages or losses caused by the termination/suspension of services.

Additional Fees

Lumiverse Dynamic is not responsible for any taxes or fees that must be paid in any country according to the local tax laws related to transactions made by the service user through the provided server. The user agrees that they are fully responsible for any taxes, fees, or charges related to the use of the server, the products or services offered, or any transactions conducted.

Limitation of Liability – Indemnification – Compensation

Lumiverse Dynamic makes significant efforts to ensure that the website https://lumiverse.gr includes accurate and up-to-date information. However, it does not guarantee the accuracy, timeliness, or completeness of the published content and, as such, bears no responsibility for any type of liability.

The service user agrees to defend, indemnify, and hold harmless Lumiverse Dynamic from any claims, losses, financial demands, and liabilities, including attorney fees, and protect it from any case or claim arising from damage, injury, or any other cause brought by the user or any third party against Lumiverse Dynamic or the service user, due to the user’s activities, services, or other acts, including content or information processed through Lumiverse Dynamic’s servers or due to any server malfunction, with or without the user’s consent or involvement of a third party.

Furthermore, the service user explicitly declares and binds themselves that, if any lawsuit, claim, or legal or administrative proceeding arises against Lumiverse Dynamic due to any violation of third-party rights by the user, they are obliged to intervene in the legal or administrative procedure and indemnify Lumiverse Dynamic fully if it is required to pay any compensation or other costs.

Acceptance of Terms of Use

These terms of use for the website www.lumiverse.gr are drafted based on the entire body of laws governing the Greek territory, governed by Greek Law, relevant European Union legislative provisions, and International Treaties. They are to be interpreted according to the principles of good faith, commercial ethics, and the social and economic purpose of the law. Lumiverse Dynamic provides third-party software depending on the service ordered. The license terms governing the use of third-party software may differ from the terms of use of Lumiverse Dynamic. Lumiverse Dynamic customers are bound by all terms of the licenses associated with third-party software and must accept them. The provision and offering of third-party software is not part of Lumiverse Dynamic’s software. Lumiverse Dynamic cannot provide support or guarantees regarding the use and functionality of such third-party software.

Any electronic service order is sent to Lumiverse Dynamic via the Internet, only after the user has unconditionally accepted the aforementioned terms of agreement, serving as additional proof that the service user has fully understood and unconditionally agreed to these terms.

The service user agrees that for any dispute arising from the use of this presentation, the laws of the Greek state will apply, and the competent court for resolving these matters will be the Athens Courts. The terms contained herein supersede any other agreement or negotiation between the service user and Lumiverse Dynamic, whether oral, written, or otherwise, including any statements made by a representative of Lumiverse Dynamic.
